Suspended jail term for chain-dragging, hammer blows

An Australian man who admitted dragging an injured horse with a chain and killing it with two hammer blows has received a suspended four month jail sentence.
Phillip Crane, of Boree Creek, received the sentence last week when he appeared for sentence in Wagga Wagga Local Court on three admitted charges - aggravated cruelty, committing an act of cruelty and failing to take necessary steps to alleviate pain to his male horse.
The case began when a New South Wales RSPCA inspector was called to a report of a dead horse in a council reserve at Boree Creek on April 7.
There was evidence the horse had been dragged to the location for about 400 metres. Disturbed ground around the horse's body indicated it has been left to thrash around before its death.
During an interview, Crane admitted he had found the horse tangled in a fence on April 4 last year.
As the horse did not have the strength to stand, Crane said he placed a chain around a rear leg and dragged it behind his vehicle while it was still alive.
Crane returned to the horse some 45 minutes later and admitted using a hammer to strike the animal twice on the head to kill it.
Crane was sentenced to four months imprisonment for aggravated cruelty and two months imprisonment for committing an act of cruelty, both sentences to be served concurrently.
The magistrate then suspended the sentence, placing Crane on a four-month good behaviour bond.
Crane was fined $A2500 on the charge of failing to alleviate pain in the animal and ordered to pay $A76 court costs and $A79.20 in transcription costs. He was also ordered to present to police for fingerprinting.
